Thinstuff END-USER LICENSE AGREEMENT.

Before using this PRODUCT, carefully read the following terms and conditions.  Installation, copying or use of the PRODUCT by you indicates your acceptance of this agreement.  This is a legal and binding agreement between you and Thinstuff s.r.o (THINSTUFF). If you do not accept this agreement, no license is granted to you for use of the software and you must immediately return the unused software and all accompanying items (including any associated media, printed material, and "online" or electronic documentation (the "documentation"), packaging materials, and box) to the seller for a refund.  You are not authorized to use the PRODUCT unless and until you accept this agreement.

LICENSE.

The term "PRODUCT" herein refers to the THINSTUFF software product and Documentation, collectively. The PRODUCT is licensed, not sold. THINSTUFF grants you a non-exclusive, non-transferable license to install and use the computer software if installed according to the instruction contained in the documentation. The license is limited to the number of licenses purchased.

PURSUANT TO THE LICENSE, YOU ARE SUBJECT TO THE FOLLOWING CONDITIONS:

You may:

1. Use the PRODUCT only for its intended purpose as described in the Documentation.
2. Make one copy of the Software solely for backup purposes.

You may not:

1. Modify, translate, reverse engineer, decompile, disassemble, create derivative works based on, or copy (except for the sole backup copy) the PRODUCT.
2. Rent any part of the PRODUCT to any person without the prior written consent of THINSTUFF.
3. Remove any proprietary notices, label, or marks on the PRODUCT.
4. Use the PRODUCT outside of the country in which it was purchased regardless of whether such use was accomplished by physical or electronic transfer of the PRODUCT.
5. Electronically transfer the PRODUCT from one computer to another over a network.
6. Sublicense, assign, delegate or otherwise transfer this license or any of the related rights or obligations for any reason, except as may be expressly authorized herein.  Any such attempt to sublicense, assign, delegate or transfer shall void this license.
7. Separate the component parts of the PRODUCT (the PRODUCT is licensed as a single product).
8. Resell or otherwise transfer possession of the entire PRODUCT.

THINSTUFF retains all proprietary rights, titles, and interests in and to the PRODUCT, including, without limitation, all patents, trademarks, copyrights, and trade secrets, regardless of the form or media in or on which the PRODUCT, or any part thereof, may subsequently exist.  Unauthorized use of the PRODUCT or failure to comply with the above restrictions shall result in automatic termination of this license and shall make available to THINSTUFF other legal remedies.  This license is not a sale of any of the THINSTUFF proprietary rights.

NO WARRANTIES.  

THINSTUFF expressly disclaims any warranty for the PRODUCT. The PRODUCT and any related documentation is provided to you "as is", without warranty of any kind, express, implied, or otherwise, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose or of non infringement. The entire risk arising out of use or performance of the product remains with you. The above exclusions may not apply to you, as some states do not allow the exclusion of implied warranties.  You may also have other rights, which very from state to state. THINSTUFF expressly disclaims any warranty for the PRODUCT. The PRODUCT and any related documentation is provided to you "as is", without warranty of any kind, express, implied, or otherwise, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose or of non infringement. The entire risk arising out of use or performance of the PRODUCT remains with you. The above exclusions may not apply to you, as some states do not allow the exclusion of implied warranties.  You may also have other rights, which very from state to state.

NO LIABILITY FOR DAMAGES.  

In no event shall THINSTUFF or its suppliers be liable for any damages whatsoever, including, without limitation, loss of data, lost profits, business interruption, or other special incidental, consequential or indirect damages, arising out of the use or inability to use the product, or any portion thereof, however caused and on any theory of liability.  This limitation shall apply even if THINSTUFF has been advised of the possibility of such damages.  Some states may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you.

COPYRIGHTS.

Copyright laws and international treaties as well as other intellectual property laws protect this PRODUCT. All title and copyright in and to the PRODUCT, including but not limited to, any text, images, photographs, animations, video, audio, and "applets" incorporated into the PRODUCT and any copes of the PRODUCT are owned by THINSTUFF. Copyright law and international treaty provisions protect the PRODUCT.

SUPPORT SERVICES.  

THINSTUFF may provide you with support services related to the PRODUCT. Use of support services is governed by THINSTUFF policies and programs, as described in the Documentation and/or other materials provided by THINSTUFF. Any supplemental software code provided to you as part of the Support Services shall be considered part of the PRODUCT and subject to the terms and conditions of this agreement.

TERM AND TERMINATION.  

The license provided herein is effective until terminated.  You may terminate this license at any time by destroying or returning to THINSTUFF the PRODUCT and any backup copy thereof.  This license automatically terminates if you fail to comply with the terms and conditions of this Agreement.  You agree that upon such termination, you will destroy (or permanently erase) or return to THINSTUFF the PRODUCT and any copies.  

EXPORT RESTRICTIONS.  

You agree not to export or transmit the PRODUCT to any country to which export is restricted by applicable law or regulation without the written approval of the appropriate Government organization.

The manufacturer is Thinstuff s.r.o, Svrčia 7, 841 04 Bratislava, Slovakia.

GENERAL.  

This Agreement shall be governed by the laws of the State of Austria, without reference to conflicts of law principles.  This Agreement is the entire agreement between the parties and supersedes any other communications or advertising with respect to the PRODUCT.
